The State Duma has passed in the second reading the bill, regulating the work of the sea ports in Russia.
In particular, this document regulates the issues related to the construction, opening and closure of sea ports, specifies the operation procedure of seaports and the state regulation of the port activities.
The bill presupposes the creation of the register of the sea ports.
In accordance with this document the Administration of the sea port is a federal state establishment, which is headed by the Captain of sea port. Captain issues the registration documents for the vessels, including the ones under construction, ensures the safety of navigation and the order in the port.
General traffic rules, rules of berthing and safety rules in the sea ports are set in this document. It is specified that the guarding of the borders of the facility and port infrastructure can be performed by private security guards.
The document differentiates seaport as a property complex and organizations operating in the port and describes the main scope of services, including the handling of cargoes, vessels and passengers.
It also specifies the procedure for the use of land plots and water objects within the limits of seaports and presupposes that the property rights for the land plots can’t be given to the legal entities and private entrepreneurs. But the land plots with the waterside structures and facilities, purchased by the private investors, can be in private property.
According to this document the territory of a sea port can include the land plots, which are in private property, and such land plot can be purchased.
At the same time, it prohibits private property for foreigners, stateless persons and foreign legal entities. The bill introduces the list of the infrastructure facilities of sea port, which were withdrawn from business and included in state property. The facilities, not included in this list, can be in state, municipal property and also in the property of private entrepreneurs and legal entities.
The bill also specifies details as regards the lease of land plots including agreements for lease and investments into state-owned seaport infrastructure facilities.
