Saint-Petersburg city court prohibited the port trade union committee of the dockers and the strike committee of the workers of CJSC “First Stevedoring Company” to continue the strike.
According to the article 413 of the Labor Code of the Russian Federation the strike process was prohibited until the court would pass the judgment on the claim of administration of CJSC “FSC” against the port trade union committee of dockers and the strike committee of CJSC “FSC” for adjudication of the indefinite strike action illegal (the strike started on October, 25th, 2007). The main reason is refusal of workers to perform discharge of dangerous cargoes, which are listed among the ratified minimum of obligatory works. This action creates an instant danger for life and health of the people living in the neighborhood of the port, staying on the adjacent vessels and also for the participants of the strike themselves and it is a serious violation of the existing legislation of the Russian Federation.
The ruling of the city court was passed on November 16th, 2007. The court resolved to stop the strike till December 14th, 2007. In accordance with the current law all illegal strike actions should be immediately terminated.

In accordance with the requirements of the Labour Code of Russian Federation the strike can be carried out only provided that workers are performing the ratified minimum of obligatory works.
